Pension + Gratuity Delay — RTI for Retirement Benefits

Pension RTI - RTI Wiki

The Pension Rules (CCS Pension Rules 2021 + state equivalents) commit pension processing to start 6 months BEFORE retirement; gratuity must be paid within 1 month of retirement; PPO (Pension Payment Order) issued within 30 days; family pension within 14 days of death certificate. Beyond these, the Supreme Court in State of Kerala v. M. Padmanabhan Nair (1985 SCC OnLine SC 25) established the right to interest on delayed gratuity at bank rate.

TL;DR: Pension processing 6 months pre-retirement. Gratuity 1 month. PPO 30 days. Family pension 14 days. Padmanabhan Nair: interest on delayed gratuity. 🪄 Draft my Pension RTI →

Where retirement benefits get stuck

  • Service-book verification at office of last service — most common bottleneck.
  • Pension commutation calculation — Drawing & Disbursing Officer (DDO).
  • Service certificate from earlier postings — when employee transferred multiple times.
  • AG (Audit) clearance — Comptroller & Auditor General office.
  • Bank pension start — public sector bank credit.
  • PPO + family-pension PPO — for nominee.
  • CPAO (Central Pension Accounting Office) / state equivalent — for centralised pension.

Case law to cite

  • State of Kerala v. M. Padmanabhan Nair (SC 1985) — interest on delayed gratuity at bank rate; landmark.
  • DS Nakara v. UoI (1983) 1 SCC 305 — pension is deferred salary, not bounty.
  • Suchet Singh v. State of Punjab (P&H HC 2024) — pension delay >1 year attracts compensation in writ.
  • Subhash Chandra Agarwal v. CPAO (CIC 2019) — pension file noting disclosable.
  • Anjali Bhardwaj v. UoI (SC ongoing) — IC vacancies hurt pension RTIs.

Escalation

  1. Day 0 — RTI to DDO + parallel RTI to AG/CPAO.
  2. Day 0 parallel — Email CPAO at cpao.nic.in grievance.
  3. Day 0 parallel — CPGRAMS at pgportal.gov.in.
  4. Day 30 — RTI reply due.
  5. Day 60 — First Appeal.
  6. Day 150 — Second Appeal to CIC.
  7. Last resort — Writ under Article 226; Padmanabhan Nair gives strong precedent.

Family pension extra notes

  • Documents needed: Death certificate, marriage certificate (for spouse), birth certificate (for child), nominee form on file with employer.
  • Timeline: 14 days for first family pension under most state pension rules.
  • Common issue: Nominee not updated in service book before death — solvable via affidavit + RTI for nominee form audit.

FAQ

I retired 6 months ago and pension hasn't started — what RTI?

File RTI to your last DDO asking for the questions above, especially the date of forwarding to AG. If forwarded, parallel RTI to AG/CPAO. Padmanabhan Nair (SC 1985) entitles you to interest at bank rate on delayed gratuity.

Family pension delayed for my deceased parent — what to do?

(a) Submit death certificate + your relationship proof to last DDO; (b) Demand PPO under §7(1) “life or liberty” 48-hour rule (since your livelihood depends on it); © RTI to AG/CPAO if no movement in 14 days.

Is my pension PPO disclosable?

Your own PPO is yours under §3 + §6. The PIO must furnish.

Can I get interest for delay in gratuity / commutation?

Yes — State of Kerala v. M. Padmanabhan Nair (SC 1985) is binding precedent. Interest at bank rate from date of retirement until actual payment.
