RC Book Delay — RTI to Force the RTO to Reply in 30 Days
The Motor Vehicles Act, 1988 read with Central Motor Vehicle Rules 1989 (CMVR Rule 47, 50, 53) gives every vehicle owner the right to receive the Registration Certificate (RC) within 30 working days of submitting Form 20 (new registration), Form 29/30 (transfer), Form 25 (renewal), or duplicate-RC application. Where RC gets stuck
- “Document verification pending” — at RTO; usually 5-7 days normal.
- “Awaiting Senior Inspector approval” — internal sign-off; common bottleneck.
- “Smart card despatch pending” — vendor backlog at central printer.
- “Hypothecation continuation pending” — for financed vehicles after loan closure.

- Send by Registered Post with acknowledgement card if filing by post — keep proof.

Common reasons your RC is stuck — and what to do
👉 "Awaiting Senior Inspector approval" for over 14 days
Why: Internal RTO bottleneck — Senior Inspector backlog or absence.
What to do: Visit the RTO with the receipt; ask the dealing clerk in writing for the Senior Inspector's name and the approval queue position. If unresolved in 7 days, file the RTI above.
👉 "Smart card despatch pending" for over 14 days
Why: Vendor printing queue at central printer (often Pune/Bengaluru/Chennai).
What to do: Email RTO + State Transport Commissioner. Include the print-job ID if shown on portal. RTI specifically asks for vendor SLA + penalty status.
👉 NOC from previous state pending (inter-state transfer)
Why: Inter-state RTO communication delays. Old RTO has not closed your record.
What to do: File parallel RTI to the previous-state RTO PIO asking for NOC issuance status. Often the NOC was issued but never sent.
👉 Hypothecation continuation pending
Why: Bank has not sent the loan-closure letter to RTO.
What to do: Get a fresh loan-closure letter from the bank; submit at RTO. RTI to bank's PIO if loan-closure letter is delayed.
👉 RC despatched but not received
Why: Speed Post issue; address mismatch; recipient not present.
What to do: Track AWB on India Post. Visit Post Office. RTI to RTO + India Post Speed Post centre for re-despatch.
👉 RC rejected for "address proof not valid"
Why: Address proof not on the MORTH-accepted list.
What to do: Re-submit with documents from the MORTH accepted list — passport, Aadhaar, electricity bill (latest), rental agreement registered.

- Day 0 — RTI to RTO PIO (template above).
- Day 0 parallel — Grievance at Sarathi/Parivahan portal.
- Day 0 parallel — Email RTO + State Transport Commissioner.
- Day 0 parallel — CPGRAMS at pgportal.gov.in tagged Ministry of Road Transport.
- Day 7 — Visit RTO with receipt + senior-officer meeting if possible.
- Day 30 — RTI reply due under §7(1).
- Day 60 — First Appeal under §19(1) to FAA (usually Senior RTO / DTO).
- Day 150 — Second Appeal to State Information Commission.

How long does an RC book take in 2026?
30 working days under CMVR Rule 47 + the smart-card vendor SLA. New registrations + transfers + duplicates all share this 30-day window. HSRP-affixed RCs may need additional 30 days.
What is the RTI fee to the RTO?
₹10 under Central RTI Rules and most state rules. Higher in Punjab, UP, MP, Haryana, Tamil Nadu (₹50). Gujarat ₹20. BPL exempt under §7(5).
Is my RTO covered by RTI?
Yes — every State Transport Department + every Regional Transport Office is a “public authority” under §2(h) of the RTI Act, 2005. Each has a designated PIO (usually the Joint RTO / DTO / Office Superintendent).
Can I get someone else's RC details via RTI?
Restricted — owner data is “personal information” under §8(1)(j). However, vehicle registration number, vehicle category, fuel type, owner's first name are partly public via the Vahan portal. For full owner data, you must show a legitimate purpose (insurance dispute, accident victim, etc.) and the PIO will balance under §8(2).
My RC despatched but Speed Post says "delivered" — I never received

Can I drive on the basis of online RC if smart card is delayed?
Yes — the digital RC on mParivahan / DigiLocker app is legally valid under MORTH circular 2018. Carry it on your phone. Smart card is supplementary.
Hypothecation closure not reflecting on RC despite loan paid — what RTI?
File RTI to (a) bank's PIO for the loan-closure letter date and (b) RTO PIO for the hypothecation-removal Form 35 application status. Both should reach RTO within 7 days of bank closure.
