+===== MLA fund RTI: How to track MLA LAD funds and file RTI for utilization =====
 +
+MLA Local Area Development (MLA LAD) fund — complete guide on tracking and filing RTI for utilization:
 +
+  - **Step 1: What is MLA LAD fund?** (a) the MLA Local Area Development (MLA LAD) scheme — provides each MLA with an annual allocation — for development works in their constituency — the amount varies by state: (i) Delhi: Rs 10 crore per MLA per year, (ii) Maharashtra: Rs 5 crore, (iii) UP: Rs 2 crore, (iv) Karnataka: Rs 2 crore, (v) Tamil Nadu: Rs 2.5 crore — check the state's scheme guidelines for the exact amount, (b) the MLA recommends works (like roads, drains, street lights, community halls, water supply, etc.) — and the district administration executes the works — and the funds are released — to the executing agency, (c) the MLA LAD fund is different from the MP LAD fund (which is for MPs — at Rs 5 crore per year — for their constituency).
+  - **Step 2: How to track MLA LAD funds.** (a) the state government publishes the MLA LAD scheme guidelines (on the state's website — including the allocation — and the eligibility — and the process), (b) the district administration maintains the MLA LAD register (with the works recommended — and the funds released — and the expenditure — and the completion status), (c) some states have online portals (e.g., Delhi has an online portal — for MLA LAD works — where the citizen can check the works — and the status — and the expenditure), (d) the citizen can file RTI (to get the MLA LAD details — see Step 4), (e) the CAG audits the MLA LAD scheme (and reports on the utilization — and the deficiencies — and the unspent amount).
+  - **Step 3: Common issues with MLA LAD funds.** (a) funds not released (the state government delays the release of funds — to the district administration — which delays the works), (b) funds not utilized (the MLA does not recommend works — or the district administration does not execute — and the funds lapse — at the end of the financial year), (c) poor quality work (the contractor does sub-standard work — and the infrastructure is poor), (d) favoritism (the MLA recommends works — only in select areas — or for select beneficiaries — ignoring other areas — and vulnerable groups), (e) ghost works (the works are shown as completed — on paper — but are not actually executed — or are executed partially), (f) inflated bills (the contractor inflates the bills — and the MLA and the officials collude — and siphon off the funds).
+  - **Step 4: File RTI on MLA LAD funds.** File RTI with the district administration (the Collector/Deputy Commissioner — who is the PIO for MLA LAD funds) asking for: (a) the allocation: "Provide the MLA LAD fund allocation — for [MLA name] — for the year [year] — including: (i) the total allocation, (ii) the funds released, (iii) the funds utilized, (iv) the unspent amount", (b) the works: "Provide the list of works recommended by [MLA name] — under MLA LAD — for the year [year] — including: (i) the work name, (ii) the location, (iii) the sanction amount, (iv) the executing agency, (v) the tender amount, (vi) the contractor, (vii) the start date, (viii) the completion date, (ix) the completion status, (x) the quality test report", (c) the utilization: "Provide the utilization certificate — for MLA LAD works — in [constituency] — for the year [year] — including: (i) the work, (ii) the amount sanctioned, (iii) the amount spent, (iv) the verification — and the approval", (d) the complaints: "Provide the complaints received — regarding MLA LAD works — in [constituency] — from [date] to [date] — and the action taken — and the status", (e) the audit: "Provide the CAG audit report — on MLA LAD — for [state] — for the year [year] — including: (i) the findings, (ii) the deficiencies, (iii) the unspent amount, (iv) the action taken — on the audit findings".
+  - **Step 5: How to use the RTI reply.** (a) verify the works (visit the work site — and verify whether the work is actually completed — and the quality — and the measurements — match the RTI reply), (b) compare with the register (check the district administration's register — and the online portal — and compare with the RTI reply — for discrepancies), (c) file a complaint (if the RTI reply shows discrepancies — or ghost works — or inflated bills — file a complaint with: (i) the district administration, (ii) the anti-corruption bureau, (iii) the Lokayukta, (iv) the CAG), (d) approach the media (share the RTI reply with the media — to create public pressure — and to force the government to act), (e) file a PIL (in the High Court — for public interest — the court can order an inquiry — and recovery).
+  - **Step 6: State-wise MLA LAD amounts.** (a) Delhi: Rs 10 crore per MLA per year (highest in India — the Delhi government increased the allocation — from Rs 4 crore to Rs 10 crore), (b) Maharashtra: Rs 5 crore per MLA per year (increased from Rs 3 crore), (c) Kerala: Rs 3 crore per MLA per year (through the Local Area Development Fund), (d) Tamil Nadu: Rs 2.5 crore per MLA per year, (e) UP: Rs 2 crore per MLA per year, (f) Karnataka: Rs 2 crore per MLA per year, (g) Rajasthan: Rs 2 crore per MLA per year, (h) MP: Rs 2 crore per MLA per year, (i) Bihar: Rs 1 crore per MLA per year, (j) West Bengal: Rs 1 crore per MLA per year — check the state's latest guidelines — for the current allocation.
+  - **Step 7: Practical tips.** (a) check the online portal (before filing RTI — check the state's MLA LAD portal — for the work details — and the status), (b) file RTI early (to get the work details — before the records are lost — or the files are destroyed), (c) be specific (mention the MLA name — and the constituency — and the year — and the work — for a focused reply), (d) verify on the ground (visit the work site — and verify — and take photos — and measurements — and compare with the RTI reply), (e) Example: A citizen filed RTI with the district administration — asking for the MLA LAD works in his ward — the reply showed that Rs 50 lakh was spent on a road — but the citizen visited the site — and found that the road was not constructed — the citizen filed a complaint with the anti-corruption bureau — and approached the media — the ACB investigated — and found that the work was a ghost work — and the MLA and the contractor were chargesheeted — and the funds were recovered.
