Is Gambling Legal in Your State? A Plain-Language Map for Indians

Direct answer. Betting and gambling is a State subject under Entry 34 of the State List — but that now governs offline play only. Since 1 May 2026 the central Online Gaming Act 2025 bans every online real-money game nationwide, skill or chance. Offline, Goa, Daman and Sikkim allow licensed casinos. Tamil Nadu, Karnataka, Andhra Pradesh and Telangana also ban online gambling under their own laws, and the Supreme Court upheld the Tamil Nadu and Karnataka bans on 27 May 2026. Three questions decide everything for any state:

1. Is the game you're playing skill or chance? Chance is illegal almost everywhere.
2. Is the format online or offline? Online has its own central law from 1 May 2026 (see explainer) plus state overlays.
3. Is your state in the explicit-ban list? Three states ban most online real-money gaming outright.

If chance + online + ban-state → triple illegal. Since 1 May 2026 skill + online + money is illegal too: the Online Gaming Act 2025 bans online money games nationwide, whether skill or chance. The state map below governs offline play.

• Bucket A — no state-specific ban before 2026: Most states. Public Gambling Act 1867 baseline, with no state law of their own against online skill games. The central Act has banned online real-money play here too since 1 May 2026.
• Bucket B — Restrictive (online real-money games banned): Tamil Nadu, Andhra Pradesh, Telangana, Karnataka — and some categories in Nagaland, Sikkim.
• Bucket C — Regulated casino state: Goa, Daman & Diu, Sikkim — physical casinos under state licence.
• Bucket D — Regulated lottery state: Kerala, Punjab, Maharashtra, Goa, Sikkim, Mizoram, Nagaland, Manipur, Madhya Pradesh, West Bengal, Arunachal Pradesh, Meghalaya — state-government lotteries operate. Assam's position is disputed; private lotteries banned (Lotteries Regulation Act 1998).

A state can be in multiple buckets (e.g., Goa is in C + D).

Note: This table is the offline picture, and the state rows describe the position before 1 May 2026 for online play. Since then the Promotion and Regulation of Online Gaming Act, 2025 bans online real-money games in every state — there is no central registration route for one. State bans remain in force for offline gambling.

Suhana, 22, design student from Chennai, downloaded a fantasy cricket app on her cousin's recommendation during IPL 2025. She added ₹500 via UPI. The app immediately blocked her — her PAN-linked KYC showed Tamil Nadu address; the app's compliance flagged her as a restricted-state user. Her cousin in Bengaluru kept playing without issue. Suhana later filed an RTI to the Tamil Nadu Cyber Crime Wing using AI RTI Drafter asking how many apps had been blocked for onboarding users in the state. Enforcement of the TN ban was uneven, but compliant apps did obey it. Since 1 May 2026 the question is national: no app may offer real-money play anywhere in India.

Same product, different state, different legal reality. That is why this map matters.

The hardest cases are skill games — fantasy sports, rummy, poker.

• Skill was historically protected — the Supreme Court in RMD Chamarbaugwala (1957) and Lakshmanan (1996), and the Punjab and Haryana High Court in Varun Gumber (2017), had held skill games are not “gambling” under Article 19(1)(g). On 27 May 2026, however, the Supreme Court held in State of TN v. Junglee Games (2026 INSC 594) that betting on games of skill is gambling and attracts no Article 19(1)(g) protection, and that states may ban it.
• State legislatures can restrict them on grounds of public order or addiction — confirmed by the Supreme Court on 27 May 2026 in State of TN v. Junglee Games (2026 INSC 594), which upheld the Tamil Nadu Prohibition of Online Gambling Act 2022 and the Karnataka 2021 amendment.
• Litigation status (August 2026) — the Supreme Court decided the TN and Karnataka challenges on 27 May 2026 (2026 INSC 594), upholding both bans, and review petitions against it are pending. The AP and Telangana bans stand. The central Online Gaming Act 2025 bans online money games nationwide from 1 May 2026, and a constitutional challenge to that Act is pending in the Supreme Court with no stay.

When in doubt, check the registration status of the specific app in official records and then confirm whether your state separately restricts that category of game.

• Illegal casino app guide — spot, report, recover

• Believing “Goa is legal so my Goa-based site is legal”. Goa allows in-person casinos. Online sites under a Goa licence are not automatically legal across India.
• Thinking this is only a Tamil Nadu, Karnataka, Andhra Pradesh or Telangana problem. Since 1 May 2026 no PAN, no state and no KYC address makes an online real-money deposit lawful anywhere in India.
• Treating Sikkim/Nagaland licences as a national pass. They are not — those are state-level licences with limited reach.
• Assuming a state where there is no local ban is therefore safe for online play. It is not. Since 1 May 2026 the central Act bans online real-money games nationwide, and state bans continue to apply to offline gambling on top of that.
• Trusting blog posts that say “X is legal in 2024”. The law changed on 1 May 2026 and again in the Supreme Court on 27 May 2026 — check the current position.

No, and the question is now moot: since 1 May 2026 online real-money play is banned in every state, so there is no permissive state to route to. Your jurisdiction is fixed by KYC, the payment gateway and your PAN-linked address, not your IP. The Act's penalties are aimed at the operator and the payment channel rather than at you, but your deposit is unprotected and your account can be caught in an investigation.

Poker played offline in recreational clubs was held to need no police licence in Karnataka (Indian Poker Association v State of Karnataka, Karnataka HC, 2013). Banned in TN, AP, TS and Karnataka. From 1 May 2026, real-money online poker is banned nationwide under the federal Online Gaming Act 2025.

Same as poker — historically skill in most states; banned in TN, AP, TS and Karnataka. Head Digital Works (Kerala 2021) cleared the constitutional position for rummy; the Madras HC's 2021 Junglee Games ruling was reversed by the Supreme Court on 27 May 2026 (2026 INSC 594). Since 1 May 2026 the federal Act bans real-money online rummy nationwide.

Yes. Lottery winnings are taxable at 30% flat under §115BB of the Income Tax Act with TDS at the same rate. Same as gaming winnings.

No. Private lotteries are banned under the Lotteries (Regulation) Act 1998. Only state-government lotteries are permitted (in the states that have them).

Gambling law in India is state-by-state plus a new central overlay from 1 May 2026. Five clean rules:
