	+	On 12 October 2025, the Right to Information Act, 2005 completed twenty years of operation. The Act was assented to on 15 June 2005 and came into force on 12 October 2005. It repealed and replaced the Freedom of Information Act, 2002.
	+
	+	On the occasion of the twentieth anniversary, Satark Nagrik Sangathan, a civil society organisation that has tracked the functioning of the Information Commissions from 2006 onward, released its annual assessment. The assessment covers the performance of the Central Information Commission and the State Information Commissions between 1 July 2024 and 30 June 2025.

	+	On 30 June 2025, the total number of appeals and complaints pending before twenty-nine Information Commissions stood at more than four lakh cases.

	+	During the year 1 July 2024 to 30 June 2025, twenty-seven Commissions disposed of approximately 1.8 lakh cases. The disposal rate has fallen in relation to the rate recorded in the earlier year, which indicates a worsening of the pendency-to-disposal ratio.

	+	Section 20 of the Right to Information Act, 2005 empowers the Commission to impose a penalty of up to twenty-five thousand rupees on a Public Information Officer who, without reasonable cause, refuses to receive an application, does not furnish information within the time specified, malafidely denies a request, knowingly gives incorrect or incomplete information, destroys information, or obstructs the furnishing of information.

	+	The assessment records that in approximately ninety-eight per cent of cases in which a penalty was eligible to be imposed, no penalty was imposed. The imposition of penalty has remained the exception rather than the rule across successive years of assessment.
	+
	+	The consequence is a weakening of the deterrent that Section 20 was intended to create. Public Information Officers who delay or deny information face limited risk of a personal financial liability, though adverse observations in the order of the Commission continue to be recorded and communicated to the parent authority.
	+
	+	===== Gender representation =====
	+
	+	The assessment records that of all persons appointed as Information Commissioners in the Central Information Commission and State Information Commissions from 2005 onward, approximately nine per cent have been women. The figure is considered low in relation to the representation of women in other statutory appointments and reflects a composition that has not changed appreciably across successive appointments.

	+	===== Compliance with statutory reporting =====
	+
	+	Section 25 of the Right to Information Act, 2005 requires each Commission to prepare an annual report on the implementation of the Act during the year, and to forward the report to the appropriate Government. The report is required to be laid before each House of Parliament or the State Legislature as the case may be.
	+
	+	The assessment records that twenty of twenty-nine Commissions had not published an annual report for 2023-24 at the time of the assessment. The failure to publish the annual report is a departure from a statutory obligation and impairs the Parliamentary and Legislative oversight of the working of the Act.
	+
	+	===== Transparency of the Commissions themselves =====
	+
	+	A related finding is that a number of Commissions do not place basic information on their own websites in the manner required of other public authorities under Section 4. The information that is not uniformly available includes:
	+
	+	- the date of filing of each second appeal and complaint;
	+	- the stage of each case;
	+	- the next date of listing;
	+	- the orders passed by each bench, classified and searchable.
	+
	+	The position improved in Commissions that have modernised their case management. The assessment notes that Telangana's case management portal has reduced average processing time by a significant margin, and suggests that other Commissions consider a similar investment.
	+
	+	===== Implications for practice =====
	+
	+	==== For applicants ====
	+
	+	* Applicants should file second appeals with a complete set of enclosures and clearly numbered grounds. Appeals with gaps are more likely to be adjourned.
	+	* Where an application has remained unanswered beyond thirty days, a first appeal should be filed without waiting for a reply. The clock for the second appeal runs from the date of decision of the first appeal or the expiry of the period for such decision.
	+	* Where a Commission is known to have long pendency, the grounds in the second appeal should be drafted with the Commission's likely written disposal in view. A clear, numbered set of grounds allows a written order to be passed without repeated listings.
	+
	+	==== For Public Information Officers ====
	+
	+	* The continued low rate of penalty imposition should not be read as an absence of accountability. Orders of the Commission are recorded in the service record of the Officer and form part of the institutional reputation of the public authority.
	+	* Replies should address every limb of the application separately. A composite reply that does not address each limb is the single most common ground on which adverse observations are recorded.
	+
	+	==== For Commissions ====
	+
	+	* The publication of the annual report under Section 25 is not a discretionary matter. It is recommended that each Commission place the latest annual report on its website within three months of the close of the year.
	+	* Case management portals that permit real-time filing, tracking, and order retrieval are associated with higher disposal rates.
	+
	+	===== Reform proposals commonly raised =====
	+
	+	Several reform proposals have been raised in academic and policy literature and have been considered by Parliamentary Committees in earlier years. The proposals that continue to be raised include:

	+	- Filling of vacancies in the Central Information Commission and State Information Commissions one to two months before the date on which the vacancy is expected to arise, in line with the directions of the Supreme Court in //Anjali Bhardwaj v. Union of India//.
	+	- Appointment of Information Commissioners from backgrounds beyond retired civil service, including from law, journalism, and academia, in line with the fields of eminence listed in Section 12(5).
	+	- A statutory time-limit for disposal of a second appeal from the date of its filing.
	+	- Restoration of the fixed tenure and salary framework for Information Commissioners that was in effect before the Right to Information (Amendment) Act, 2019.
	+	- A review of the amendment to Section 8(1)(j) effected by Section 44(3) of the Digital Personal Data Protection Act, 2023, to restore the public interest override that had operated through the earlier text of the clause.

	+	In December 2025, Shri Raj Kumar Goyal was sworn in as the Chief Information Commissioner by the President of India, Smt. Droupadi Murmu, at a ceremony at Rashtrapati Bhavan. Eight new Information Commissioners took oath at or around the same period.

	+	With these appointments, the Central Information Commission reached its full sanctioned strength of one Chief Information Commissioner and ten Information Commissioners. This is the first time since 2016 that the Commission has operated at full strength.
	+
	+	The post of Chief Information Commissioner had remained vacant from 13 September 2025, the date on which Shri Heeralal Samariya demitted office on completion of his term.
	+
	+	===== Selection process =====
	+
	+	Appointments to the Central Information Commission are governed by Section 12 of the Right to Information Act, 2005. The Chief Information Commissioner and Information Commissioners are appointed by the President on the recommendation of a three-member Committee comprising:
	+
	+	- the Prime Minister, who is the Chairperson;
	+	- the Leader of the Single Largest Opposition Party in the Lok Sabha; and
	+	- a Union Cabinet Minister to be nominated by the Prime Minister.
	+
	+	Under the Right to Information (Amendment) Act, 2019, the term, salary, and other conditions of service of the Chief Information Commissioner and Information Commissioners are no longer fixed by the Act itself. They are prescribed by the Central Government by rules made under the Act. The current rules provide a term of three years for both the Chief Information Commissioner and Information Commissioners. The Chief Information Commissioner is not eligible for reappointment.

	+	The appointee is required to be a person of eminence in public life with wide knowledge and experience in one or more of the following fields: law, science and technology, social service, management, journalism, mass media, or administration and governance. On appointment, the appointee stands retired from any parent service from which they may have come.

	+	===== Composition of the Commission =====
	+
	+	As of April 2026, the composition of the Commission is as follows.
	+
	+	* Chief Information Commissioner: Shri Raj Kumar Goyal.
	+	* Information Commissioners: ten members, with the eight newly sworn-in Commissioners together with those already in office at the time of Shri Samariya's demission.
	+

	+	===== Why full strength matters =====
	+
	+	Section 12(5) of the Act permits a Commission of up to ten Information Commissioners in addition to the Chief Information Commissioner. The Commission functions through benches. The disposal rate of second appeals and complaints depends directly on the number of benches available on any working day.
	+
	+	From 2016 onward, the Commission operated at less than its sanctioned strength. At various points in 2024 and 2025, only three or four Commissioners were in office, with a backlog that at its height exceeded 23,000 second appeals and complaints. The Supreme Court, in orders passed in //Anjali Bhardwaj v. Union of India// (2019) 10 SCC 1 and in subsequent proceedings, directed that vacancies be filled in a time-bound manner. In January 2025, the Supreme Court recorded concern about the functioning of the Commission.

	+	The return to full strength allows the Commission to restore benches to the Sections that had been collapsed due to shortage of Commissioners. The first operational effect will be visible in the disposal rate over the next two quarters. The second-order effect, which is the time an applicant waits for a second appeal to reach hearing, will take longer to correct.

	+	===== Pendency position inherited by the Commission =====
	+
	+	On the basis of publicly available figures, the Commission had a pendency of the order of 23,000 second appeals and complaints as of January 2025. The disposal rate had crossed ninety per cent for the financial year 2023-24 on the strength of hybrid hearings. Pendency fell in that year but began to rise again as vacancies went unfilled.

	+	Applicants whose second appeals were filed in 2023 and 2024 should expect hearings to be listed progressively over the next year as the new benches stabilise. A speaking order from the Commission, whether allowing or dismissing the appeal, is the end-point of the second appellate process. Thereafter, the remedy lies in writ jurisdiction before the appropriate High Court.

	+	* A well-reasoned speaking order at the first appellate stage reduces the scope of the second appeal and narrows the points for consideration before the Commission.

	+	===== Pending questions =====

	+	The constitutional challenge to the Right to Information (Amendment) Act, 2019 on the ground of institutional independence remains pending. The 2019 amendment altered the tenure, salary, and other conditions of service from those earlier fixed in parity with the Chief Election Commissioner to those to be prescribed by the Central Government by rules.

	+	The question of whether the Chief Information Commissioner and Information Commissioners should be granted a constitutional status, similar to the Chief Election Commissioner, has been raised in academic and policy literature. The question is not currently before Parliament but continues to be raised in submissions to successive Law Commission exercises.

	+
	+	On 14 November 2025, the Ministry of Electronics and Information Technology notified the Digital Personal Data Protection Rules, 2025. The notification brought Section 44(3) of the Digital Personal Data Protection Act, 2023 into force. By the operation of that sub-section, clause (j) of sub-section (1) of Section 8 of the Right to Information Act, 2005 stood substituted.

	+	The effect is immediate. Every RTI application pending on or filed after 14 November 2025 is to be decided under the substituted clause.
	+
	+	===== The text: before and after =====
	+
	+	Before the substitution, Section 8(1)(j) of the RTI Act read, in substance, that there shall be no obligation to give a citizen information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of privacy, unless the Central Public Information Officer or the State Public Information Officer or the appellate authority was satisfied that the larger public interest justified the disclosure. The clause was followed by a proviso that information which could not be denied to Parliament or a State Legislature could not be denied to any person.

	+	After the substitution effected by Section 44(3) of the DPDP Act, clause (j) reads that there shall be no obligation to give a citizen information which relates to personal information.
	+
	+	The difference is structural. Three elements of the earlier clause are no longer part of the text.
	+
	+	- The public-activity test has been removed.
	+	- The unwarranted-invasion-of-privacy test has been removed.
	+	- The larger-public-interest override has been removed.
	+
	+	The accompanying proviso regarding information that could not be denied to Parliament has also been removed.
	+
	+	===== Definition of "person" under the DPDP Act =====
	+
	+	Clause (j) is now to be read with the DPDP Act's definition of "person". Under Section 2(s) of the DPDP Act, "person" includes an individual, a Hindu undivided family, a company, a firm, an association of persons or a body of individuals whether incorporated or not, the State, and every artificial juristic person not falling within any of the preceding categories.
	+
	+	The definition is wider than the ordinary meaning. Public Information Officers should note two consequences.
	+
	+	First, information relating to a corporate entity, a firm, or an association of persons may fall within the scope of clause (j) if the information is "personal information" with reference to that entity. The position is not identical to the earlier jurisprudence under the unamended clause, which the Supreme Court had developed primarily with reference to natural persons.
	+
	+	Second, information relating to the State as a juristic person is now within the scope of the definition. The implications of this position will be tested in litigation.
	+
	+	===== How the clause must be read =====
	+
	+	The Supreme Court in //Justice K.S. Puttaswamy v. Union of India// (2017) 10 SCC 1 held that the right to privacy is a fundamental right under Article 21. The Court also held that any restriction on a fundamental right must satisfy the proportionality test.
	+
	+	The substituted clause (j) does not displace this constitutional baseline. A Public Information Officer applying clause (j) must therefore read it alongside the proportionality standard and in a manner consistent with Article 19(1)(a) of the Constitution, under which the right to information is derived.
	+
	+	The practical reading is this.
	+
	+	- The Officer must first determine whether the information requested is "personal information" as understood under the DPDP framework.
	+	- Where the information is not personal information, clause (j) does not apply and the application must be decided on its merits.
	+	- Where the information is personal information, the Officer must record a speaking order identifying the information, the nature of the privacy interest, and the legal basis for denial.
	+	- Section 10 of the RTI Act continues to apply. Where a record contains both exempt and non-exempt information, the non-exempt part must be severed and disclosed.
	+	- Section 8(2) of the RTI Act has not been amended. Where a public authority is satisfied that the public interest in disclosure outweighs the harm to the protected interest, access to the information may be allowed notwithstanding clause (j).
	+
	+	Section 8(2) is therefore the central provision through which the public interest reasoning continues to operate. Officers who previously relied on the larger-public-interest override within clause (j) must now route the same reasoning through Section 8(2).
	+
	+	===== Guidance for Public Information Officers =====
	+
	+	Public Information Officers should consider the following sequence when dealing with an application that seeks information relating to an individual.
	+
	+	- Record whether the information is held by the public authority, fully, partly, or not at all.
	+	- If the information is held, examine whether any exemption under Section 8 or Section 9 applies.
	+	- If clause (j) is invoked, identify the specific privacy interest and the connection between the information and that interest.
	+	- Examine whether Section 10 permits severance of non-exempt portions.
	+	- Examine whether Section 8(2) applies on the facts. Where the application engages a matter of public interest such as the utilisation of public funds, the discharge of statutory duty, or the conduct of a public servant in the course of duty, Section 8(2) must be considered on its own motion.
	+	- Issue a speaking order that sets out the reasoning, the clause invoked, and the relief granted or denied.
	+
	+	A denial without reasons is not a denial in law. The requirement of a speaking order is unaffected by the amendment.
	+
	+	===== Guidance for First Appellate Authorities =====
	+
	+	First Appellate Authorities should note that a routine reliance on the substituted clause (j), without reasoning, is not sustainable in appeal. The authority must examine whether:
	+
	+	- the Public Information Officer has recorded the privacy interest with sufficient particularity;
	+	- severance under Section 10 has been considered;
	+	- Section 8(2) has been considered where the facts engage the public interest;
	+	- the denial is proportionate to the privacy interest asserted.
	+
	+	Where any of these elements is absent, the appellate order should either direct disclosure or remand the matter for a fresh order by the Public Information Officer.
	+
	+	===== Guidance for applicants =====
	+
	+	Applicants seeking information that relates to an individual, an entity, or the State should frame requests with the following elements.
	+
	+	- State the information sought with precision. Broad requests are more likely to attract the clause.
	+	- Where the information concerns a public servant acting in the course of duty, state this element in the application and request the Officer to consider Section 8(2) on its motion.
	+	- Where severance is possible, state the request in terms that permit severance under Section 10.
	+	- In a first appeal or second appeal, the grounds should engage Section 8(2) and the Puttaswamy proportionality standard. A mere assertion of the right to know is unlikely to succeed without a public interest reason tied to the specific information.
	+
	+	===== Pending legal and policy questions =====
	+
	+	Several questions are expected to be decided in coming months.
	+
	+	- The constitutional validity of Section 44(3) of the DPDP Act has been raised in public statements by senior members of the legal community, including a letter from Justice A.P. Shah, former Chief Justice of the Delhi High Court and former Chairperson of the Law Commission of India, urging reconsideration of the provision.
	+	- In April 2025, a petition signed by more than one hundred and twenty Opposition Members of Parliament was submitted to the Union Minister of Electronics and Information Technology seeking repeal of Section 44(3).
	+	- Civil society organisations and press bodies have submitted representations during and after the draft rules consultation. The Editors Guild of India and the Press Club of India have both recorded concerns on the effect on journalistic work.
	+	- The Government's position, stated in press releases and parliamentary replies, is that the amendment harmonises the RTI framework with the fundamental right to privacy affirmed in Puttaswamy, and that Section 3 of the DPDP Act preserves disclosures required by other laws and disclosures of information voluntarily placed in the public domain.
	+
	+	The position of Information Commissions on the application of the substituted clause will develop through orders passed in the next cycle of second appeals.
	+
	+	===== Action points =====

	+	* Officers are advised to review Office Memoranda and standing instructions on Section 8(1)(j) and update them to the amended text.
	+	* Training material used for PIO and FAA capacity building should be revised to reflect the routing of public interest reasoning through Section 8(2).
